C&D Automotive provides automotive repair, maintenance, custom bodywork, and performance services as described on our website and service menu. All services are subject to availability, vehicle inspection, and written authorization from the customer prior to work being performed.

We reserve the right to decline service at our discretion, including for safety reasons or capacity constraints.

All repair estimates are provided in writing prior to work being started. By authorizing an estimate, you agree to pay for the services described upon completion.

• Estimates are based on visible conditions at the time of inspection. Additional charges may apply if hidden damage or additional faults are discovered. We will contact you for authorization before proceeding with work beyond the original estimate.
• Verbal authorizations may be accepted in limited circumstances and will be noted in your service record.
• Colorado law (C.R.S. § 42-9-102) governs written estimates and customer authorization for motor vehicle repairs.

Payment is due in full upon completion of services unless a prior written agreement has been made. We accept cash, major credit/debit cards, and other payment methods as posted at our location.

• Returned checks are subject to a $35 returned check fee plus any bank charges incurred.
• Vehicles not picked up within 10 business days of service completion may be subject to storage fees of up to $25 per day.
• We reserve the right to retain a mechanic’s lien on your vehicle until payment in full is received, as permitted under Colorado law.

By providing your phone number, you expressly consent to receive automated SMS text messages and automated voice calls from C&D Automotive and our CRM platform operated by Afterburner Systems LLC. These communications may include:

• Appointment confirmations, reminders, and follow-ups
• Responses to service inquiries submitted via web form, phone, or text
• Post-service review requests
• Missed call callbacks via AI-powered voice agent

Message and data rates may apply. You may opt out at any time by:

• Replying STOP to any SMS message
• Calling us directly at (719) 618-4889 to request removal

Calls handled through our automated phone system may be recorded for quality assurance and service improvement purposes. By continuing a call, you acknowledge and consent to recording. C&D Automotive discloses this practice in accordance with Colorado law (C.R.S. § 18-9-303).

6.1 Parts and Labor Warranty

Unless otherwise stated in writing, our repairs carry a 90-day / 3,000-mile warranty on parts and labor, whichever comes first. This warranty covers defects in workmanship and faulty replacement parts installed by us.

The warranty does not cover damage caused by accidents, misuse, neglect, modifications, or pre-existing conditions unrelated to the repaired system.

6.2 Disclaimer of Other Warranties

Except as expressly provided above, services are provided “as is.” We make no other warranties, express or implied, including warranties of merchantability or fitness for a particular purpose, to the fullest extent permitted by Colorado law.

To the maximum extent permitted by law, C&D Automotive’s liability for any claim arising from services provided shall be limited to the amount paid for those specific services. We are not liable for indirect, incidental, consequential, or punitive damages.

Nothing in these Terms limits liability for gross negligence, willful misconduct, or as otherwise required by Colorado law.

You agree to:

• Provide accurate and complete information about your vehicle and the issue you are experiencing
• Retrieve your vehicle within a reasonable time after service completion
• Inform us of any known pre-existing conditions that may affect service
• Ensure your vehicle is legally titled and you have authority to authorize repairs

A vehicle is considered abandoned if not retrieved within 30 days of service completion or written notice. Abandoned vehicles will be handled in accordance with Colorado Revised Statutes § 42-4-2102 et seq., which may include notification to the registered owner and disposition through legal channels.

These Terms are governed by the laws of the State of Colorado. Any disputes arising from services or these Terms shall be resolved in the courts of El Paso County, Colorado.

We encourage customers to contact us directly to resolve any concerns before pursuing formal legal action. Most issues can be resolved quickly with a direct conversation.

We may update these Terms at any time. Updated Terms will be posted on our website with a new effective date. Continued use of our services after updates constitutes acceptance of the revised Terms.
